U.S. Customs and Border Protection ("CBP") has issued "interim final regulations" implementing the "Importer Security Filing and Additional Carrier Requirements" , so-called 10+2 Rule, which requires 10 data elements from importers and 2 data elements from carriers. The new Importer Security Filing program applies to goods shipped to the United States via vessel and will require the submission of certain data elements to CBP via AMS or ABI system at least 24 hours before the goods are laden on board the vessel. The new Importer Security Filing ("ISF") program becomes effective on January 26, 2009.
CBP has provided a "structured review and flexible enforcement period" of at least 12 months. During this period, CBP will "show restraint" and forego the issuance of liquidated damages or penalties to importers and ISF Filers making a good faith effort to comply with the new ISF requirements.
After the "structured review and flexible enforcement period" officially ends, the ISF importer must provide a complete, accurate and timely filing or risk liquidated damages in the maximum amount of US5,000.

The US Customs 24-hour rule requires all ocean carriers or NVOCC (Non Vessel Operating Common Carriers) to submit a complete cargo manifest to US Customs “Automated Manifest System” at least 24 hours prior to cargo loading for shipments bound for the United States. Details of cargo manifest must be based on actual declaration of cargo by the shipper and must be submitted via EDI (Electronic Data Interchange) to US Customs.
